KwikEat Desktop licence terms

1. Who we are

These terms apply to the sale of KwikEat Desktop licences by AnyKey Software Solutions, based in Hellevoetsluis, the Netherlands, Chamber of Commerce (KvK) number 24282587, email info@anykey.nl.

2. Who it is for

KwikEat Desktop is intended for businesses, such as take-away and delivery restaurants. By ordering, you declare that you act in the course of a trade or business. Consumer sales rules, including the right of withdrawal, therefore do not apply.

3. The licence

You receive a non-exclusive, non-transferable right to use KwikEat Desktop within your own business. The licence is registered to the licence holder given with the order; that name is bound to the licence code. You may not resell, rent out or otherwise make the software available to third parties.

4. Term and renewal

A new licence is valid for 370 days from the day it is issued. The licence does not renew automatically: you renew by ordering a new licence. Once the licence has expired, KwikEat Desktop keeps working, but printing is no longer available.

If you renew within two months before or after the expiry date of your existing licence, you receive the renewal discount shown with the order, and the new licence is valid for 370 days from the expiry date of the old licence. If you renew earlier or later, the new licence counts as a new licence, without discount, from the day it is issued.

5. Price and payment

The price is the price shown with the order, excluding VAT. VAT is charged as required by law; for businesses in another EU country with a valid VAT number, the reverse-charge rule applies. You pay online through our payment provider Stripe, using the payment link on the website or in the email with the invoice.

6. Delivery

Once your payment has been received, you receive the licence details (licence holder, licence code and registration code) and the invoice by email. You enter the licence details in KwikEat Desktop's licence window. On each computer you can try KwikEat Desktop free of charge once for 14 days before entering a licence. Keep your licence details safe: you need them for installation and renewal.

7. Use and data

You are responsible for the computer KwikEat Desktop runs on, for backing up your data, and for complying with privacy law regarding the customer data you record in KwikEat Desktop.

8. Liability

KwikEat Desktop is provided as is. We do our best to fix errors, but do not guarantee that the software works without errors or interruptions. Our liability is limited to the amount you paid for the current licence period. We are not liable for indirect damage, such as lost revenue or loss of data, except in the case of intent or deliberate recklessness.

9. Privacy

How we handle the data you provide with your order is described in our privacy policy.

10. Changes and applicable law

We may change these terms. An order is governed by the terms as they appeared on this page at the time of ordering. These terms are governed by Dutch law. Disputes are submitted to the competent court in the district of Rotterdam.
